Welcome to Upwise, operated by Upwise LLC, a California limited liability company (“Upwise,” “we,” “our,” or “us”).


These Terms of Service (“Terms”) govern your use of our websites — including www.climbupwise.com — and our web application (“App”), as well as any coaching, assessments, or related services we provide (collectively, the “Services”).

By creating an account, purchasing a subscription, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy and Waiver and Release of Liability.

If you do not agree, please do not use our Services.

1. Eligibility and Accounts

  • You must be at least 18 years old to create an account.
    Users under 18 may participate only with written parental or guardian consent.

  • You agree that all information you provide is accurate and kept up-to-date.

  • You’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

  • You may request deletion of your account and associated data at any time by emailing support@climbupwise.com.

2. Nature of Services

Upwise provides remote coaching, training plans, and educational guidance for climbing and fitness.
We are not medical professionals, and our coaching does not constitute medical advice, diagnosis, or treatment.
Always consult a qualified health-care provider before beginning any new exercise program or following training recommendations.

By participating, you acknowledge and agree to our Waiver and Release of Liability, which is incorporated into these Terms by reference.

3. Subscriptions and Payments

  • Subscriptions are billed through Squarespace Payments (powered by Stripe).

  • Charges occur automatically on a recurring basis until you cancel.

  • You may cancel anytime through your account or by contacting support@climbupwise.com.

  • Refunds: If you cancel mid-month, you may receive a refund of up to half of your most-recent monthly charge, pro-rated to the number of days remaining in the current billing period.
    Example: Cancel on day 10 of a 30-day month → 50% refund; cancel on day 20 → refund for 10 days.

  • We encourage, but do not enforce, a three-month minimum commitment to give your training plan time to show results.

  • Upon cancellation, you’ll retain limited access to your account history but will no longer receive new workouts or active coaching updates.

4. Data and Privacy

Your privacy matters. We collect and process personal information as described in our Privacy Policy.

Data collected may include:

  • Basic profile details (name, pronouns, age, experience level)

  • Physical and climbing-related information (height, weight, injury history, goals, preferences)

  • Training logs, performance data, and assessment results (sets, reps, RPE, grades, timestamps)

  • Account and authentication data (email, hashed password, role, activity timestamps)

All data is stored securely and used solely to deliver and improve your coaching experience. You may request deletion of your data at any time by contacting support@climbupwise.com.

Upwise uses Squarespace, Stripe, and other service providers, each subject to their own privacy policies.

5. Health and Safety

Participation in physical training involves inherent risks.

By using our Services, you acknowledge that you assume full responsibility for your own safety and that Upwise cannot be held liable for injury, illness, or damages arising from participation.

If you experience pain, dizziness, or any health concern, stop immediately and consult a medical professional.

Report any injury or limitation to your coach as soon as possible. Upwise may suspend or modify your training if continued participation appears unsafe.

6. Intellectual Property

All content provided through Upwise — including text, graphics, logos, training materials, templates, software, and data structures — is the property of Upwise LLC or its licensors and is protected by U.S. and international copyright and trademark laws.

You’re granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal training purposes.
You may not copy, distribute, modify, or resell any portion of our Services without written consent.

7. User Conduct

You agree not to:

  • Share, sell, or sublicense your account access.

  • Upload malicious code or interfere with the operation of our site or app.

  • Misrepresent your health, age, or capabilities in a way that could compromise safety.

  • Use the Services for any unlawful, abusive, or commercial purposes beyond personal coaching.

Violation of these rules may result in suspension or termination of your account.

8. Right to Refuse Service

Upwise reserves the right to refuse, suspend, or refund service at its sole discretion if:

  • Participation poses a health or safety risk, or

  • A user violates these Terms or acts abusively toward Upwise staff.

Refunds under such circumstances will follow the policy outlined in Section 3.

9. No Guarantees

Upwise makes no guarantees regarding specific performance outcomes, climbing grades, or fitness results. Progress depends on individual effort, consistency, and personal circumstances.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided “as is” and “as available.”

  • Upwise disclaims all warranties, express or implied, including fitness for a particular purpose.

  • Upwise and its members, coaches, and contractors shall not be liable for indirect, incidental, or consequential damages, or for any injury or loss arising from participation, data use, or service access.

Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any dispute arising out of or related to these Terms or the Services shall be resolved by binding arbitration in Marin County, California, under the rules of the American Arbitration Association.

Each party bears its own costs and attorney fees, unless otherwise required by law.

Either party may bring a qualifying claim in small-claims court instead of arbitration.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll post the revised version on our website and update the “last updated” date above. Continued use of our Services after changes are posted means you accept the updated Terms.

Acknowledgment

By using the Services, you acknowledge that you have read, understood, and agreed to these Terms, including the Waiver and Release of Liability incorporated herein.

Coaching Liability Waiver

This Waiver and Release of Liability (“Agreement”) is entered into between the undersigned participant (“Participant”) and Upwise LLC (“Upwise”), a California limited liability company. By participating in any assessment, training, coaching, or related activity offered by Upwise, I acknowledge and agree to the following:

1. Health and Medical Condition

  • I attest that I am in good health and that my physical condition is sufficient for participation in climbing and training activities.

  • I understand that it is my responsibility to consult a qualified medical professional regarding any health concerns or pre-existing conditions before engaging in physical activity.

  • I will immediately inform Upwise of any injury, medical condition, or change in my health status that may affect my ability to safely participate.

  • I understand that Upwise coaches are not medical professionals, and that no advice, instruction, or information provided by Upwise should be construed as medical advice, diagnosis, or treatment.

2. Assumption of Risk

I understand and acknowledge that climbing, training, and physical conditioning involve significant risks, including but not limited to:

  • Falls, slips, or loss of grip;

  • Overexertion, muscle or tendon strain, sprains, and other soft-tissue injuries (especially to fingers, elbows, and shoulders);

  • Equipment failure;

  • Adverse environmental conditions such as temperature or humidity;

  • Improper or unsafe application of training guidance;

  • Actions or negligence of other participants or third parties;

  • Adverse effects on mental health, including anxiety or fatigue.

I acknowledge that such risks may result in serious injury, permanent disability, or death.
I voluntarily assume all risks, both known and unknown, associated with participation in Upwise assessments, training plans, and coaching, whether conducted in person, online, or remotely.

3. Release and Waiver of Liability

In consideration of being permitted to participate, I, for myself and my heirs, executors, and assigns, hereby release, waive, discharge, and covenant not to sue Upwise LLC, its owners, members, employees, contractors, and agents, from any and all claims, demands, losses, causes of action, or liabilities arising out of or related to:

  • Any injury, illness, or death that may occur as a result of participation;

  • The provision or application of training advice or guidance; or

  • Any alleged negligence by Upwise or its representatives.

This release applies to all activities associated with Upwise services, including but not limited to assessments, personalized coaching, training plans, performance tracking, and follow-up communication.

4. Indemnification

I agree to indemnify, defend, and hold harmless Upwise LLC, its owners, coaches, contractors, and agents from and against any and all claims, actions, suits, costs, expenses, damages, and liabilities (including attorney’s fees) arising from my participation in or application of Upwise’s services.

5. Not Medical Advice or Professional Diagnosis

I understand that:

  • Upwise coaches are not physicians, physical therapists, or licensed medical professionals;

  • All guidance and recommendations are for educational and informational purposes only;

  • I should not disregard or delay seeking medical advice because of something I read, hear, or receive from Upwise;

  • My use of Upwise services does not create a doctor–patient or healthcare relationship.

6. Injury Reporting and Suspension of Services

If I become aware of any injury or potential injury:

  • I will immediately cease participation and seek appropriate medical advice;

  • I will notify Upwise of the injury as soon as possible;

  • I will not resume activity until cleared by a qualified medical professional and Upwise deems it safe to continue.

7. Right to Refuse or Refund Service

Upwise reserves the right, at its sole discretion, to refuse, suspend, or refund services if it determines that a participant is unfit to safely perform the recommended training or assessments, or if participation poses an undue risk to health or safety.

8. No Guarantees

I acknowledge that Upwise LLC makes no guarantees regarding specific performance outcomes, climbing grades, or physical results. Progress depends on individual effort, consistency, and personal circumstances.

9. Severability

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. Governing Law

This Agreement shall be governed by and construed under the laws of the State of California.

Coaching Subscriptions

When you subscribe and purchase a membership on this website, we collect personal information from you to enable your member sites access. We may collect information like your:

  • Billing and shipping address

  • Details relating to your subscription

  • Email address

  • Name

  • Phone number

We share this information with Squarespace, our website hosting provider, so that they can provide exclusive member site hosting services to us.

As you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience.

Squarespace Payments

When you make a purchase from us on this website, we use Squarespace Payments as our payment solution. Squarespace Payments is a fully integrated, native payment solution provided to us by our online store service provider Squarespace. Squarespace Payments makes use of the following third party service providers which will also receive your personal information and process it in accordance with their privacy policies:

Emails

Order and Account Emails

We may email you with messages about your order or account activity. For example, we may email you to tell you that:

  • You’ve created a customer account

  • Your customer account password has been reset or updated

  • You’ve made a purchase

  • Your order has shipped

It’s not possible to unsubscribe from these messages.

We share your contact information with Squarespace, our website hosting provider, so they can send these emails to you on our behalf.

Abandoned Cart Emails

You’ll receive an automated email within 24 hours after you abandon your shopping cart, if all of the following occur:

  1. You enter your email address at checkout, or are logged into your customer account.

  2. You add a product which is in stock to your shopping cart.

  3. You close your browser or leave this website without completing your purchase.

You can unsubscribe from these messages at the bottom of the email.

The email will link back to this website, where you can pick up where you left off and complete your purchase.

Upwise Web App Privacy Addendum

This section applies to your use of the Upwise web application (“App”), available to registered athletes and coaches through app.climbupwise.com, and describes how Upwise LLC (“Upwise,” “we,” “our,” or “us”) collects, stores, and uses information provided through the App.

1. Information We Collect

When you use the App, we collect information that helps deliver your personalized coaching experience, track progress, and improve performance analytics. The information you provide may include the following categoriesAppDataCollected:

  • Account & Authentication Data – Email, hashed password, user role (athlete or coach), and account activity timestamps.

  • Profile Details – First and last name, pronouns, gender, date of birth, climbing experience level.

  • Physical Data – Height, weight, armspan, and unit preferences (imperial or metric).

  • Medical & Training History – Injury history, training limitations, and optional menstrual-cycle tracking preference (for training adjustments).

  • Climbing & Training Data – Goals, training preferences, facility/equipment access, workout completion details (sets, reps, RPE, duration, notes), and climbing session logs (attempts, sends, grades).

  • Assessment Results – Performance test results such as Max Hang, Core Strength, Shoulder Stability, Flexibility, and others.

  • Schedule & Availability – Weekly availability, primary gym, and disruptions (vacations, trips, etc.).

  • System Metadata – Coach–athlete relationships, assignment history, timestamps, and assessment status.

We do not collect or store payment information in the App. All payments are processed securely through Squarespace Payments (powered by Stripe) on our main site.

2. How We Use This Information

We use App data to:

  • Generate and update personalized training plans.

  • Track workout and assessment progress.

  • Allow coaches to monitor performance and provide tailored feedback.

  • Improve our training algorithms, plan recommendations, and athlete experience.

  • Maintain internal logs for performance tracking and troubleshooting.

We do not sell, rent, or otherwise share your data with third parties for marketing or advertising purposes.

3. Data Access and Security

  • All sensitive data is stored securely in our managed database and protected by Row-Level Security (RLS) policies, ensuring each user can only access their own information (or their assigned athletes’ data if acting as a coach)AppDataCollected.

  • We use industry-standard encryption for data in transit and at rest.

  • Only authorized Upwise staff and contractors have access to user data when necessary to provide support or improve service performance.

You may request a copy of your data or deletion of your account at any time by contacting support@climbupwise.com.

4. Cookies and Local Storage

The App uses minimal, first-party cookies and local storage only to support essential functionality.
We do not use cookies or scripts for analytics, advertising, or tracking.

The App also uses localStorage (a browser-based storage mechanism) for limited, functional purposes:

  • Saving survey progress.

  • Remembering a coach’s last-viewed athlete.

  • Maintaining progress in the climbing-session tracker.

  • Storing Supabase authentication tokens to keep you signed in (no cookies are used for login).

LocalStorage data never leaves your device and can be cleared at any time through your browser settings.

5. Google Fonts and External Services

The App loads fonts via Google Fonts. Google may receive standard technical information (browser, device, IP address) solely to deliver those font files.
We do not use any third-party analytics, tracking pixels, or ad networks.

6. Data Retention

We retain your App data while your account remains active. If you delete your account or request removal, your identifiable data is deleted from our systems within 30 days, except where retention is required by law or for legitimate business purposes (for example, accounting or fraud prevention).

Aggregated or anonymized data used for statistical analysis may be retained indefinitely.

7. International Users

Although Upwise LLC is based in the United States, athletes outside the U.S. may use the App. By using the App, you consent to the transfer and processing of your data in the United States, which may have different data-protection laws than your country of residence.

8. Your Rights

Depending on your location, you may have the right to:

  • Access and receive a copy of your data.

  • Request corrections to inaccurate or incomplete information.

  • Request deletion of your personal data.

  • Withdraw consent for data processing (where applicable).

9. Updates to This Policy

We may update this Addendum periodically to reflect technical or legal changes. If updates materially affect how we handle your data, we will notify you by email or via the App interface.
